What is compared?
The contractual rate, changes during the term, a suitable reference rate and all payments are reconstructed. The starting rate, subsequent changes, credit balance and the lender’s calculation method can materially affect the outcome.
Compensation is not always the end of the matter
A generic scheme or unilateral offer should be checked against the actual agreement and payment history. It is also important to establish whether the offer is final, which period it covers and whether accepting it affects further rights.
Complaint route
A substantiated calculation is first put to the lender. If the response is inadequate, a consumer may in suitable cases continue through Kifid. The Dutch financial complaints institute publishes guidance on variable-interest credit and compensation calculations. Read Kifid’s guidance.
The outcome depends on the agreement, evidence, limitation issues and previous settlement or acceptance.
